Untried Muslim detainees in India

(By Dr.ABUL RUFF COLACHAL)

India is hailed as a country where democracy flourishes on large scale.December 06, the date the Indian history would remember forever as on that date in 1992 democracy was finally assassinated in India with the destruction of Babri Mosque and follow-up torture of the Muslims all over the country, is fast approaching. Upon the destruction of the Mosque, the then ruling Congress government had pledged to reconstruct the mosque at the very site where it existed, but till date the construction has not even started. In order to suppress the Muslims who demand the reconstruction of the Mosque the Indian state has only terrorized them through various nefarious actions harmful to and undermining the Muslims.Every year many Muslims are rounded up on the eve of December-6 anniversary and not many from the detainees return home quite safe.Indians, particularly those settled down comfortably abroad, mainly in the West, are both proud of and obsessed with the so-called Indian democratic values and feel happy to see the Muslims in India are painted in dirty colors and portrayed as bad guys to death with severely, are perhaps unaware of the fact that this country has contempt of legal aspect of the retaining detainees without trails. Obviously on instructions from the Union government,, the state government in Tamil Nadu refuses to speed up the trial .

The killing of a Russian journalist Politkovkaya has caught the attention of the Western media mainly because the victim was not a Muslim and had not been a pro-Putin government, but also a pro-West journalist. Muslims are also killed and tortured by the US led forces worldwide but the global media refuse to highlight the facts as they have done it in Russia's case, for Russia is criticised for its lack of democrratic traditions. Human rights record of India is known to be very low and the media efficiently hide the facts of torture if the victims are Muslims.

The Muslims and others retained in jails without trial are too large and common to need illustrations. Usual contempt of law by Indian State could be gauged by the way the Muslims are treated in the country after the destruction of the Mosque at Ayodhya. The Muslims who are arrested before the 6th Dec every year and tortured in jails across the country, are neither tried nor released because, according to the government, arrested persons are "terrorists" and so they deserve prolonged punishment in jails without trials, but quite scared of facing the legality of the matter involved. It is any one's guess as to what makes the government both at the Centre and in states not to produce the so-called suspected terrorists before the courts of law and let judiciary deliver judgments. In Tamil Nadu alone, for instance over 350 Muslims were reportedly arrested between 22nd Nov and 06 Dec 1998 and their fate is sealed in Coimbatore and other central jails in the state without any trial. The detainee Abdul Nasser Madani, a popular political leader in Kerala State who had lost his leg in a bomb blast in Kerala state way back by the anti-Islamic forces operating in the country shielded by the State, was later arrested by implicating him in a bomb blast case and is awaiting justice at Coimbatore jail for so many years now and the mass protests and the requests of state government of Kerala to speed up case and get him justice thorough court have not moved the governments both at New Delhi and in Tamil Nadu, nor have brought any good message for the people who want to see their relatives alive. It is beyond one's comprehension that the election promise made by the present ruling DMK party during the May Assembly elections to release the untried detainees if voted to power, including Abdul Nasser Madani, has not been met by the chief-minister Mr. Karunanidhi so far though the majority of the Muslims seem be with that party and he has been conspicuous by his silence over the issue.

No one can state exactly how many Muslims are retained in jails in this manner in democratic India and how many have been killed in jails, because India emboldened by the on-going terror wars waged by the USA in the Arab world on the Muslims does not care for legality of the issue on the strength of the US support for killing or torturing the Muslims anywhere in the world. The Muslim League having pretensions of serving the Muslim community and a coalition partner in the present Central government has not bothered about the securing the fast Justice to the detainees either and contented with the pleassures of power sharing with the Congresw Party. Another December 06 is fast approaching the government across India would begin yet another crackdown operations as before.

The Prime minister, Manmohan Singh and the state chief ministers, if committed to welfare of all citizens of the country, should come out with detailed reports about the details of Muslims without trials held in Indian lock-ups as well as the general position of the Muslim detainees in the country on all cases. Neither the Human Rights activists nor such organizations have taken up the matter seriously enough to halt the inhuman treatment meted out to the Muslims.Hypocrisy knows no shame or limits and has percolated into every section of the society and effectively controls it.The best option before the State under the suspicious circumstances when State's intentions in detaining the untried for so many years have not been revealed so far, is to release unconditionally the illegal detainees remaining under government custody without legal sanctions.Democracy is not a joke India can no longer claim to be one either.

(Thanking You,
Yours sincerely,

This article by the late Prof. N.K. Sheshan, former finance minister of Kerala might interest those studying Indian Culture and might throw some new light on the teachings of our gurus. It was written in 1972 for the STC Encyclopaedia Ed. GM.
INDIAN CULTURAL SYNTHESIS
India, often wrongly represented to the world outside, as a veritable scene of clashes between Hindus and Muslims, as a show-case of pomp and pageantry of the princely order, and as a land of snakes and snake-charm
ers, has a wonderful culture which is the synthesis of different cultures and which ranks among the oldest cultures of the world. Pre-Aryan in origin, it has had a continuous course of evolution through successive periods of Aryan, Moslem and foreign influences. Whether it be a political in
tion, or a social custom, or a form of art or literature, or a word, or an idea, or a cultural pattern, or an economic system whatever in short is Indian is a harmonious blend of multi-racial and multi-lingual cultural elements. Unity underlying diversity, uniformity in variety and universality en
ing in
ty are the basic features of India’s cultural tradition.
In spite of her being exposed to successive blasts of foreign invasions from time immemorial, India has maintained the basic fabric of her social life unhampered. What are called village republics, now handed down to us in a modified form and name, are as ancient as the dawn of Indian History. Described in the Vedas and the Upanishads as democratic and popular, they are the basic units of an agricultural economy. The character of India’s economic and political life has been responsible for creating a sort of rigidity of outlook which resists changes in the sphere of social life. It has also created divisions in the community known as ‘Chaturvarnya’ or the four-caste system based on a functional division of duty. A bewildering variety of languages, all influenced by Sanskrit, has added an element of unity which lies beneath the diversities seen on the surface of the stream of national life.
The story of Indian civilisation begins with Harappa and Mohenjodaro where a highly-developed urban civilisation existed about 5000 years ago. Siva and Sakthi cults prevalent in modern Hinduism have been traced to Mohenjodaro.
The Vedas illustrate the Aryan outlook on nature, humanity and di
ty. The Rig-veda, a book of hymns addressed to the great phenomena of nature like the sky, the sun, the fire, the thunder etc. conceived as living beings, is a treasure-house of information about the Aryan way of life. Though the relations between Aryans
and Dravidians described in the Vedic texts are purely hostile, it is only reasonable to conclude that a beginning had been made during the period of the Vedas in the direction of a fusion of the two cultures through a variety of intercourses and inter-actions between the two. The Ramayana and the Mahabharatha, con
ing perhaps sug
tions of an earlier conflict between the Aryans and the Dravidians indicate a recognition of the fact that each of the two cultural entities had virtues and values which an Indian can emulate to his own advantage.
The emergence of Buddhism and Jainism towards the end of the 6th Century B. C. marked the beginning of a revolt against the deeply com
plex ritualism and polytheism as well as the spiritual authoritarianism of the Hindu Priesthood; but they were not revolts against Hinduism in the wider sense.
The story of conflict and synthesis in Indian culture is carried forward and intensified with the arrival of Islam in India about the 11th Century A. D. Out of the conflict between Hindu culture with its accent on as
cism and renunciation and Islam with its emphasis on “this-worldliness” in a conception of vital, organic and social life, there arose problems which it was the responsibility of the basic nature of Indian culture to tackle. But they were not the product of any communal frenzy, but the outcome of a race for political ascendancy and economic power. Beneath all these con
flicts on the material plane, a silent process of synthesis and co-operation between the Hindu and Muslim ways of life was going on. The birth of Vaishnavism in Bengal and the origin of the Bhakti Movement in Maharashtra during the era of Mughal ascendancy may be directly ascribed to this process. In the evolution of customs and manners, of conduct and fashions, of festivals and rituals, of social activities and household affairs, and of art and architecture, the impact of the cultural interaction was greatly in evidence. The growth of a new language as a medium of com
tion among Indians of different regions and religions and the en
ment of literatures in many of the Indian languages tell us but the story of a growing fusion of the two cultures. Sankara, one of the most luminous stars of the Indian philosophical galaxy is often considered to be the best example of synthesis of Hindu, Buddhist, Christian and Islamic influences. Ac
ing to Humayun Kabir, “His extreme monism, his repudiation of all sem
blance of duality, his attempt to establish monism on the au
ty of re
vealed scriptures, his tendency to regard his own activity as mere res
tion of the original purity of the revealed truth are all el
ments” to prove the fusion of the two cultures.
But before the fusion could be completed to produce a new fabric of unrivalled excellence and elegance, there came on the Indian scene new elements of influence from the West.
The impact of western incursion differed from that of all earlier ones. Westerners came to India with no intention of settling down here. Con
ly they built up a pattern of life in consonance with their tradition; so much so India stood face to face with a culture which remained aloof from hers. Gradually there followed a period of interaction between the two. But the initial interaction was confined to the material plane; later on it developed into human relationship. The Indian Society which grad
ly gave up some of its old values and traditions was now exposed to a set of new values of life. The result was that on the traditionally ego-centric social outlook of the Indian mind was thrown open a window of western ideas of political, economic and social philosophies. Modern ideas and practices of Democracy came to us from the West. Similarly theories of socio-economic equality as well as modern scientific inventions and thoughts flowed into our land as a result of our contact with the West in the wake of British ascendancy in India. The educational minutes of Macaulay completed the process of interaction and change. Militant Chris
ty of the Western world burst forth into the melting pot of Indian life. This is evidenced by the emergence of a new pattern of life which con
tained unmistakable signs of Christian Values and beliefs. An interesting aspect of the Christian influence on Indian life is that it is out of all proportion to the number of Christians in India’s population. The mo
tous part played by Christian missionaries in the promotion of west
ern education and culture in India can never be over-estimated. They came here as traders first; but later on they turned out to be religious prop
dists and subsequently became masters of the land. On the social mind of the age they made deep imprints of their culture, which led Indians to a blind imitation of western ways of life to an extent that often ap
peared silly and foolish. But this ugly imitation of the West in utter disregard of India’s traditional values and concepts of life was not to continue for long. As any action has a natural reaction, the initial flush of enthusiasm to go after western ways gradually began to ebb out and a tendency to re
tate old values and traditions became a passion and a mission with the native population. Consequently the myth of European superiority was exploded. Essentially human and refined souls from the West came for
ward with an adoration for the hoary traditions of the East. A new con
scious
ness of Indian nationality began to assert itself which ul
ly united Indians on their historic march to the battle-ground of political liberation from the shackles of British Capitalism and Im
ism.
Freedom came to us on the 15th of August 1947. Twenty five years of political independence has left us (in 1972) many things to be desired in the sphere of social life and economic activity. The mounting figures of unemployment and under-employment together with a shocking picture of social dis
ties have naturally created an attitude of defiance and revolt in the minds of the youth. Unrest and indiscipline are the marked traits of their be
iour. They are disgusted with the old; but they are not yet conscious of the new they want. They have started causing regrets and apprehensions to the older generations in power. They even threaten to undermine the unity of the country which is the only solid national achieve
ment of Indian independence.
Their faith in democracy is fast disappearing and they are in a mood to pay any price for radical changes in the socio-economic spheres of Indian national life. It requires statesmanship of the highest order to make a sympathetic assessment of their aspirations and aims and to ca
ise their ebullient energy towards the creation of a new order. This is the mood of India to-day (1972).

Yes, Jatts of Punjab, Haryana, Rajasthan, UP and other areas of India, particular of North India, are all of the same stock. However, in certain areas and villages, you will see them more mixed with other Shudra and lower castes which were made up of Dravidians. That is why some Jatts are tall structured, fair skinned while others are smaller structured and dark.

Of all the Indian cults none is cleverer and becoming more powerful than the new Mata Amrithananda Mayi cult sprouted in a big way only a decade ago... This one is headed by the illiterate Mata Amrithananda Mayi who has a big ashram of 15 storeys in Kerala, Southern India. The cult is following the footsteps of Sai Baba in a much celeverer way... The followings includes the President, Prime Minister and several politicians...

Without anyone noticing the cult is trying to infiltrate into the economic interests of the state and country. They have huge hospitals and high tech schools and colleges... And even starting a medical college... a feat not achieved by none so far in India!!! That too in record time.

The activities of the cult are masterminded by a few individuals from behind... not seen in public so much... There is every reason to believe that this is controlled from abroad - mafia or foreign intellgient agencies or most likely both.

This is no longer an issue of faith or superstition as many wish to presume, but of a carefully planned movement to fool the public and take over the political, social and economic control of the State and even the Nation.

There has been many deaths in the Ashram .. all of them have been coevered up with political influence. The recent one happened in Juy 2002

This message is not to hurt anybody. I am open and straightforward in my opinion.

India is a country where we respect traditions and family. Therefore, we are proud to say that the importance towards family and women are culturally best in the world.

Of late, We feel the dressing trends of indian women is becoming a concern to the traditional values. A nation like "India" where we give importance to "Culture" and "Family", we see , western culture is corrupting to the core.

We are able to see many young girls walking on the road with low hip pants (showing the panties outside - they claim it as a style), without buttons on the tops. Recently, in one of the major city of india, I am able to see girls walking with low hip pants with holes made on the pants in the buttock area (this is claimed as the latest style). I am really feeling sad. Equalism and independence should not lead to a day when women walk without proper dresses. This can lead to "moral degenerosity " and make "India" another "USA" where there is no importance for "Family " and "Culture". We may use hi-fi words like "social" and "modern" etc to this culture but in reality we feel it is absurd.

Should we gear up and take some awareness before it really demolish the tradition of the country ? How team members feel.

Thanks in advance for all your replies

IS PROSTITUTION ETHICAL?
Sir,
The recent news about raids in hotels and arresting call-girls has led me to seriously
think about it. Our country, India is a land of Kamasutra which existed from very old times.
Even then people used to have sex outside their marriages and was considered spiritual. Sex
is a means to Self-Realisation. Prostitution has been declared as illegal (against law) and
even if you make punishments more harsh, it can't be stopped. On the contrary it will increase
by arresting them. Also, they get freed by pimps by paying huge amounts. Its high time it
should be made legal so that there are no pimps who take most of their incomes, which is very
much the right of these girls as they are doing social service by satisfying the men. If the men
are sex-starved they can become sex-maniacs and obsessed with sex which is the main cause of rape.
They are also psychologically helping the men. Also making it legal will stop the exploitation
of such good girls and help them to make a decent living out of it as most of the girls earn their
bread and butter from this profession. It will also help in social and psychological development of
the country.

FEEL GOOD FACTOR BOOSTS THE STOCK MARKETS.
It is happy news for the investors. The current FEEL GOOD factor has rubbed off on the Stock markets too, and the markets are buzzing, albeit, just prior to the interim budget there was a minor correction - which was expected. Corporate results for 3Q have been very encouraging for most of the companies. The Finance Minister Jaswant Singh, in his budget speech has projected a very positive picture of the economy.
On the political front, the BJP has already opted for the election mode and recommended the dissolution of the Loksabha. The party is oozing confidence, and as the FM said, if voted back to power, he has more good news in his pocket when he shall present the regular budget in May- if the NDA is voted back to power.
The good news on the economy front has continued enough for the govt. to boast - INDIA IS SHINING- the GDP growth has been over 8%. Foriegn reserves have crossed US $ 100 billion resulting in the S & P revising India's long term foriegn currency rating from Negative to stable. Bond yields remained largely flat though inflation touched 5.5%. This was driven largely by the high oil prices, as primary articles' inflation was largely under control. The rupee is also stable in the range of 45.4 to 45.6 levels.
All this means in the coming months the markets will continue to be upbeat - a good time to make money for the small investor- albiet through the Mutual Fund route.

GET A PHOREN DEGREE FROM OUR DESI MITTI.
If Mohammed cannot go to the mountain- take the mountain to Mohammed, is an old adage.
For all those students, yearning for a ' phoren ' degree but having no wherewithals to go about having it - here is a piece of good news.
After 2005, when WTO comes in force, phoren universities shall be legally allowed to set up campuses in India. As of now, universities offer degrees through tie-ups with local institutes and it is not uncommon for Indian universities to have exchange programmes with foriegn universities. The UGCs global marketing plan for Indian universities includes a program for establishing links between reputed foriegn and Indian universities and institutes.
These linkages are more in the nature of collaborative research. After WTO comes in force, there will be the obvious of studying for Foriegn degrees from India i.e. reduction in costs. For instance, to get a MBA degree from Wales could cost between 15 to 17 lakhs if you have to go there and study. But a similar course from a university tied up with Wales and offering the course in India would cost roughly 2.5 lacs. However, one would have to guard oneself the omnipresent cheaters.
And then, it remains to be seen whether Indian enterprenuers will give such graduates the same respect as the one's who come from abroad.

THE MIND OF THE DICTATOR

What did Hitler and Indira Gandhi have in common ? Or for that matter Ayatollah Khomeini and Balasaheb Thackeray ? Or further still Mussolini and Saddam Hussien ?
All were/are leaders of their countries, though at different times - authoritarian by nature-they all share a common streak. By the strength of their oratory, all these leaders could not only hold crowds spell bound but as a matter of fact they could sway their beliefs. Everybody must know or remember that when these leaders spoke in public, they were believed, admired, applauded and worshipped like Gods. They had charisma. They possessed a secret power of seduction that did not proceed from the credibility or soundness of the things they said; but from the suggestive way in which these things were said, from their eloquence or fromtheir historic art, perhaps instinctive, perhaps patiently learned and practised.
That then is the power of the Dictator. To sway people, these leaders often present a concept or an ideal which is often a myth - and then use all of their oratorial skills to make people believe in these myths.
Hitler initially had Germans going ga ga over his
'purantic aryan race' philosophy. Indira Gandhi fooled Indians with her ' Garibi Hatao' slogan, Khomeini swayed the entire Iranian nation with the concept of an Islamic revolution, Anna and later MGR wooed the Tamils with the Dravidian concept and closer to home Balasaheb Thackeray initally with his 'Marathi Manoos' concept which later on he converted to Hindutva.
In his writings, George Orwell, while commenting on the tendency to dominate others used to use a phrase ' Big B is watching you'. According to Orwell and in those days, Big B meant Big Brother.
In today's unipolar world, the context has changed but Orwell's phrase is still valid. Only, would Big B now mean Big Bush ?

THE SPECTRE OF AIDS - PREVENTION IS THE ONLY CURE.
The spectre of AIDS looms large over our country. In fact, in this century, how to tackle this dreadful disease, is going to be the biggest challenge in front of us.
A survey conducted in 2001 revealed that the total number of HIV infected people in our country was appx. 4 million. 6 states were identified as high prevalent states - Karnataka, Maharashtra, Tamil Nadu, AP, Manipur and Nagaland.
The AIDS virus was discovered in 1983. Though science and research has helped in keeping the virus under control, as of today, there is no definite cure for the disease. There is no vaccine that cures AIDS.
Drugs which are available in the market to fight HIV / AIDS are extremely expensive and beyond the reach of the common man.
So far, over 70 million people have been infected by HIV / AIDS worldwide, and over 20 million people have died. It is estimated that 16000 new infections take place every day. Of these, children living with HIV is estimated at around 3.50 million.
So, how do we- as a developing nation- where poverty is at large, respond to this awesome challenge?
As mentioned earlier, medicines to fight HIV are prohibitively expensive and out of reach for the common man. Recently, a pharma company introduced a new class of medicines called fusion inhibitors. The company had to spend over $ 600 million to develop this drug. It is reported that to manufacture this drug required over 100 seperate steps and 45 KG of raw materials to yield 1 KG of the drug.
In this scenario, for developing countries, the only cost effective option is creating awareness and prevention. The govt. should stop knee-jerk actions and devise a proper long term plan to combat AIDS. The services of NGOs should be roped in to create awareness. A blunt and straight communication - PREVENTION IS THE ONLY CURE- should be hammered continiuosly to reach all parts of the population.
Prevention means promoting usage of contraceptives. Taboos surrounding explicit refernces to contraceptives should be lifted. The govt. must ensure AWARENESS, AVAILABILITY, ACCESS AND AFFORDABILITY of contraceptives in all parts of the country.
Also for the already infected people, it is imperative that relations and society accept them as a person suffering from any other disease and take proper care of them and not shun and shame them. With proper diet and regulated life, even a infected person can enhance his life span from 5 to 15 years.

DIVERSITY IN UNITY ?
India has faced many attacks on its nationhood but has weathered it all. our strength has always been our Unity in Diversity. But can India, now well into middle age, afford to take its national unity for granted ?
In the last three weeks, we have been witness to a chain of events which underlines that our 'national unity' is under fire yet again.
A relatively localised event- Bihari students being prevented from taking part in railway recruitment tsets in Assam led to retaliatory attacks on train passengers from the North east, passing through Bihar. This led to AASU and UlFA targetting ' Hindi-speaking Biharis' leaving over 60 dead.
In Mumbai, the Shiv Sena has once again raised the 'sons of soil' issue. Sena supremo, Balasaheb Thackeray feels this is perfectly justified given the fact that there has been linguistic reorganisation of states.
It is high time that we reconsider how successful India has been in meeting this test of achieving national unity while fulfilling regional aspirations, which as we have experienced could encapsulate caste and religion based articulations.
It would be naive to expect that the tension between national unity and regional aspirations can be perfectly reconciled, just as there cannot be a perfect reconciliation of national identity and regional identities.
On one hand is the modern nation state- the main carrier of social and political developments and operating within its matrix of laws, and on the other hand are regional entities often competing with religious, ethnic identities.
For India to survive, lets hope that both of them dont try to destroy each other.

Ban on Taslima Nasreen's book is undemocratic.
The decision of the West Bengal govt. to ban Taslima Nasreen's latest book Dwikhandito is ironical because of the fact that a communist govt. is banning a book for 'its potential to outrage religious feelings'.
Here a question needs to be asked : Is banning books like Dwikhandito or more famously - The Satanic Verses - really the way to go about maintaining coomunal harmony ? Isnt clamping down on the right to freedom of expression too high a price to pay for appeasing a few outraged readers ? Also can not the act of banning the book provoke communal tensions ?
This is not the first time Taslima Nasreen is engulfed over controversies surrounding her writings. Earlier it happened with Lajja. The point to be understood is that Muslim clergy, in their quest to seek limelight and deflect attention of the community from real issues, are always seeking to clutch such straws in the winds and rake up periodical controversies. That successive govt's - be it Indian govt.- as in case of The Satanic Verses or Bangla Desh govt. in case of Lajja, or now the West Bengal Govt.- fall prey to these clergies machinations, only gives a shot in their arm.
Its high time someone calls off their bluff. By seeming to appease the forces of orthodoxy, bans can stifle larger movements for reform and open debate.
The west Bengal govt's move therefore is most unfortunate and condemnable.
